Terms and Conditions
Introduction
These Terms and Conditions (Agreement) constitute a legally binding contract between Trip Vibe Safaris Ltd (the Company, we, us, or our), a tour and travel operator registered in Kenya, and any person (Client, you, or your) who makes a booking, inquiry, or purchase of any tour, safari, or travel service offered by the Company. By confirming a booking, you agree to be bound by these Terms in their entirety.
All bookings and contracts are deemed concluded in Kenya and are governed by and interpreted in accordance with the laws of the Republic of Kenya.
1. Bookings & Reservations
1.1 All quotations provided by the Company are valid for 30 days from the date of issue and are subject to availability. A quotation does not constitute a confirmed booking.
1.2 A booking is confirmed only upon receipt of the required deposit and written acknowledgement from the Company.
1.3 The Company reserves the right to decline any booking at its sole discretion without being required to provide reasons.
1.4 Clients booking within 14 days of departure for Group Tours, or within 21 days of departure for Private Safaris, are required to pay the full tour price immediately upon booking.
1.5 All bookings are subject to park fees, government levies, and accommodation rates prevailing at the time of travel. Price increases from third-party suppliers will be passed on with reasonable notice.
2. Deposits & Payment Terms
2.1 To secure a reservation, the following deposits are required:
- Kenya-only tours: 30% of the total tour price at the time of booking.
- East Africa or multi-country tours: 50% of the total tour price at the time of booking.
- Peak-season bookings (July–October, December–January): 50% deposit required, payable within 7 days of booking confirmation.
2.2 The balance of payment is due as follows:
- Scheduled Group Tours: at least 14 days prior to departure.
- Private Safaris & Custom Packages: at least 7 days prior to departure.
2.3 If full payment is not received by the due date, the Company reserves the right to treat the booking as cancelled and retain the deposit.
2.4 All bank charges, wire-transfer fees, and currency conversion costs are the sole responsibility of the Client. The amount credited to the Company’s account must match the invoice exactly for the booking to be considered fully paid.
2.5 Accepted payment methods: Bank transfer (preferred), major credit/debit cards (subject to a 3% processing fee), and mobile money (M-Pesa Paybill as indicated on invoice).
2.6 Prices are quoted in USD unless otherwise stated. Payments made in KES will be converted at the prevailing exchange rate on the date of payment.
3. Booking Amendments
3.1 Requests to amend a confirmed booking (e.g., change of dates, accommodation, number of participants, itinerary) must be submitted in writing to the Company’s booking office.
3.2 An amendment handling fee of USD 50 per booking applies in addition to any costs levied by third-party suppliers (hotels, airlines, parks, etc.).
3.3 Amendments requested within 14 days of departure for Group Tours, or within 21 days for Private Safaris, may be treated as a cancellation and re-booking, and cancellation fees will apply.
3.4 The Company will make every effort to accommodate amendments but cannot guarantee changes can be made, particularly during peak season.
4. Cancellations
4.1 Cancellation by the Client
Cancellations must be submitted in writing to the Company’s booking office. Cancellations take effect only upon written receipt by the Company. The following cancellation fees apply:
Scheduled Group Tours:
- More than 28 days before departure: 30% of total tour price (deposit forfeited).
- 27 to 14 days before departure: 50% of total tour price.
- 13 to 7 days before departure: 75% of total tour price.
- Less than 7 days before departure or no-show: 100% of total tour price.
Private Safaris & Custom Packages:
- More than 30 days before departure: 30% of total tour price.
- 29 to 21 days before departure: 50% of total tour price.
- Less than 15 days before departure or no-show: 100% of total tour price.
There is no refund for any unused portions of a tour once it has commenced, including but not limited to meals, accommodation nights, activities, or transport.
The Company strongly recommends that Clients purchase comprehensive travel insurance that includes cancellation cover. Failure to do so is at the Client’s own risk.
4.2 Cancellation by the Company
The Company reserves the right to cancel any tour where conditions make it impossible, unsafe, or commercially unviable to operate (including but not limited to natural disasters, civil unrest, government travel advisories, or insufficient group numbers). In such cases, the Company will:
- Notify the Client as soon as reasonably practicable.
- Offer an alternative tour of comparable value, or
- Provide a full refund of monies paid, minus any non-recoverable third-party costs already incurred.
The Company shall not be liable for any additional costs incurred by the Client as a result of a Company-initiated cancellation, including international flights, visas, or other travel arrangements.
5. Itinerary Alterations
5.1 While the Company will make every reasonable effort to operate tours as advertised, itinerary details (including sequence of events, destinations, accommodation, and activities) are approximate and subject to change without prior notice due to:
- Weather conditions, road closures, or force majeure events.
- Wildlife movements and park management decisions.
- Accommodation overboooking or operational changes by third parties.
- Safety considerations as determined by the guide or Company.
5.2 In the event of a substitution, the Company will endeavour to provide an alternative of equal or greater value. No refund will be issued for alterations beyond the Company’s control.
5.3 Flight delays or cancellations by airlines are not considered alterations to the tour. The Company cannot be held liable for costs arising from flight disruptions. Clients should seek compensation directly from the relevant airline.
6. Insurance
6.1 MANDATORY: All Clients are required to hold comprehensive travel insurance prior to departure. The policy must include, at minimum:
- Medical expenses and hospitalisation (minimum USD 50,000 cover recommended).
- Emergency medical evacuation and repatriation (AMREF Flying Doctors coverage strongly recommended — approx. USD 25/person for short-term cover).
- Trip cancellation and curtailment.
- Loss of baggage and personal effects.
- Personal accident and personal liability.
6.2 Pursuant to Section 26(6) of Kenya’s Social Health Insurance Act, 2024, non-Kenyan visitors staying less than 12 months are required to hold valid travel health insurance upon entry into Kenya. Clients are responsible for ensuring compliance with this requirement.
6.3 The Company holds professional indemnity insurance and comprehensive vehicle cover with passenger liability as required by Kenyan law and Kenya Wildlife Service (KWS) regulations. However, this does not replace the Client’s obligation to hold personal travel insurance.
6.4 Proof of valid travel insurance may be requested at the time of booking confirmation or at the point of departure.
7. Liability & Limitation
7.1 The Company acts as a principal in arranging tours and as agent for third-party suppliers (including hotels, lodges, airlines, and activity operators). The Company shall not be liable for any act, omission, default, or negligence of any third-party supplier.
7.2 The Company, its directors, employees, guides, and agents shall not be held liable for any injury, illness, death, loss, damage, delay, additional expenses, or inconvenience caused directly or indirectly by:Events beyond the Company’s control (force majeure), including natural disasters, civil unrest, government action, pandemics, or acts of terrorism.
- The Client’s own negligence, actions, or failure to follow guide instructions.
- Wildlife encounters, which are inherently unpredictable and carry inherent risk.
- The negligence of third-party suppliers, including accommodation providers, airlines, and activity operators.
- Loss or damage to luggage or personal property.
7.3 Where liability cannot be excluded by law, the Company’s total liability shall not exceed the total amount paid by the Client for the specific tour in question.
7.4 Clients participate in all activities (including game drives, bush walks, water activities, mountain trekking, and adventure activities) at their own risk and must follow all guide and park authority instructions at all times.
8. Client Responsibilities
8.1 It is the Client’s sole responsibility to ensure they hold a valid passport (with at least 6 months’ validity beyond the tour end date), all required visas, and travel health documents.
8.2 The Company strongly recommends Clients consult a travel health clinic before departure regarding recommended vaccinations (including Yellow Fever where applicable) and malaria prophylaxis appropriate for Kenyan travel.
8.3 Clients must disclose any medical conditions, physical limitations, allergies, or dietary requirements at the time of booking. The Company will make reasonable efforts to accommodate special requirements but cannot guarantee all requests.
8.4 Clients are expected to behave respectfully towards local communities, wildlife, natural environments, and fellow travellers. The Company reserves the right to exclude any Client whose behaviour is deemed dangerous, disruptive, or offensive, with no refund.
8.5 Clients must comply with all Kenyan laws, park regulations, conservation guidelines, and the lawful instructions of the Company’s guides at all times.
8.6 The Company shall not be responsible for costs arising from a Client’s failure to hold valid travel documents, visas, or insurance.
9. Health, Safety & Special Requirements
9.1 Clients with pre-existing medical conditions must obtain medical clearance from a qualified physician before undertaking any physically demanding activities, including mountain trekking, walking safaris, or adventure sports.
9.2 Minimum age restrictions may apply at certain camps, lodges, and for specific activities. Clients are advised to confirm age requirements at the time of booking.
9.3 The Company maintains emergency protocols covering vehicle breakdowns, medical emergencies, and wildlife incidents. Guides hold first aid certification. The Company maintains contact with AMREF Flying Doctors for emergency evacuation services.
9.4 Single accommodation is available upon request at a supplementary cost but cannot always be guaranteed, particularly during peak season.
10. Accommodation & Tour Inclusions
10.1 Standard pricing is based on twin/double room occupancy. Single room supplements apply where requested.
10.2 In exceptional circumstances where confirmed accommodation is unavailable, the Company reserves the right to substitute with accommodation of an equivalent or higher standard, with advance notice where possible.
10.3 Inclusions and exclusions are as specified in each individual tour itinerary. Unless explicitly stated, the following are typically excluded: international flights, airport taxes, visas, travel insurance, items of a personal nature (laundry, phone calls, beverages outside of meals), and gratuities.
10.4 Park entry fees, conservancy fees, and applicable government levies are included only where explicitly stated in the tour package.
11. Force Majeure
The Company shall not be in breach of these Terms, nor liable for any delay or failure to perform its obligations, where such failure or delay results from any event beyond the Company’s reasonable control. This includes but is not limited to: acts of God, floods, drought, earthquake, epidemic or pandemic, terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations, nuclear or chemical contamination, government actions, or any other similar events. In such circumstances, the Company’s obligations will be suspended, and the Company will endeavour to offer alternatives or partial refunds at its discretion.
12. Intellectual Property
All content on the Company’s website, brochures, and marketing materials — including text, photographs, maps, and itineraries — is the sole property of Trip Vibe Safaris Ltd and may not be reproduced, distributed, or used in any form without prior written consent from the Company.
13. Privacy & Data Protection
13.1 The Company collects and processes personal data provided by Clients solely for the purpose of booking, administering, and operating tours, and for compliance with applicable Kenyan law.
13.2 Client data may be shared with third-party suppliers (accommodation, airlines, park authorities) only to the extent necessary to fulfil the booking.
13.3 The Company will not sell or share Client personal data with third parties for marketing purposes without explicit consent.
13.4 Data handling is governed by Kenya’s Data Protection Act, 2019.
14. Complaints & Dispute Resolution
14.1 Any complaints should be raised with the tour guide or Company representative at the earliest opportunity during the tour, to allow the Company the chance to resolve issues on the ground.
14.2 Formal complaints must be submitted in writing to the Company’s office within 14 days of the end of the itinerary. The Company will acknowledge receipt within 5 business days and provide a full response within 21 business days.
14.3 If a complaint cannot be resolved amicably, the matter shall be referred to mediation or, failing that, to the courts of Kenya in accordance with the Arbitration Act (Cap 49, Laws of Kenya).
14.4 These Terms shall be governed exclusively by and construed in accordance with the laws of the Republic of Kenya.
15. Acceptance of Terms
By confirming a booking with Trip Vibe Safaris Ltd – whether through written confirmation, payment of a deposit, or verbal agreement – the Client acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions in their entirety, including on behalf of all persons in the booking party.
These Terms may be updated periodically. The version in effect at the time of booking confirmation shall govern the contract.
